Affidavit: Baylor University student choked out woman in Waco, sexually assaulted her, then sent text to apologize
WACO, Texas (KWTX) A Baylor University student is accused of choking out and sexually assaulting a woman after they were refused entry into a local bar during an altercation, an arrest warrant states.
Declan Polglaze, 19, of Carton, Australia, is charged with aggravated sexual assault, a first-degree felony.
The sexual assault happened at about 11:30 p.m. on Dec. 5 and was reported to police on Dec. 8.
The victim told police she and Polglaze went to a bar and Polglaze was denied entry into the bar by security because he became aggressive with other patrons waiting in line.
Polglaze reportedly tripped during the altercation and fell on the victim, knocking her to the ground.
The victim and Polglaze went back to her apartment after the incident. She said she was changing in the bathroom when Polglaze picked her up and carried her to her bed.
At that moment, according to the warrant, Polglaze placed his hands around the victim's neck and choked her until she passed out.
"When the victim woke up the next morning, her shorts had been removed, and her body suit was unclipped, leaving her vagina exposed," police wrote in the arrest warrant, "She had a bruised eye, abrasions above and under her left eyebrow, a cut on her nose, and bruising on her throat."
The victim asked Polglaze how she was injured and the man said he did not know, the warrant states.
Polglaze reportedly took the victim to an urgent care clinic the morning of Dec. 6.
The victim told police that it wasn't until until Dec. 7 that she recalled being choked by Polglaze, the warrant states.
She said she was experiencing vaginal pain and bleeding and received treatment at a Waco hospital. The victim also described vomiting blood and experiencing throat swelling, police wrote in the warrant.
Medical staff at the hospital conducted a SAFE exam and noted vaginal tearing. The victim then filed a police report on Dec. 8. Medical staff also described the victim's throat bruises and injuries as being consistent with strangulation, police said.
A detective spoke with several witnesses who did not recall the victim being bruised or injured the night of the incident at the bar. The same witnesses said they first noticed the victim's injuries the following morning.
Witnesses further told the detective that Polglaze was "intoxicated and aggressive" the night of Dec. 5 and that he has a "history of becoming intoxicated and violent," the warrant states.
During a police interview, Polglaze described sending text messages to the victim on Dec. 6 to apologize for what happened, the warrant states.
The detective noted one of the messages stated, "I don't want you to be scared of me and that can't happen again." Police seized Polglaze's phone as evidence.
Polglaze allegedly told the detective he could not remember whether he choked the victim out or not.
Police wrote in the arrest warrant that "strangulation creates a substantial risk of death, which is the aggravating factor in this sexual assault."
Polglaze was booked into the McLennan County Jail on Dec. 16. His bond amount is not yet listed online.
