Bingo. Pharmaceutical companies had too much $$$ to lose to let this stand. Had to find a democratically-appointed activist judge to keep those profits in place. Apparently the minimalist approach that Denmark utilizes would be unconstitutional. Somehow.

It will be overturned of course, but for now it's a temporary victory for Big Pharma.

Because judges have the necessary scientific background to be involving themselves in these decisions.

Interesting take in that RFK, Jr. is not a scientist or doctor, but apparently, he has the scientific background to drive all this.

Also, one of the big conservative wins of the second Trump term was a SCOTUS ruling saying that federal judges do not have to defer to the scientific expertise of federal agencies. I guess that was a mistake now?

I think this ruling is based on an earlier decision that RFK had unlawfully fired the entire 18-member board and replaced it entirely with vaccine skeptics.

In other words, the judge isn't relying on this science or that science but rather on violations of the APA.

But I can't find the actual decision to read, so whatever.

Good Lord, that is not what that opinion said at all.

The opinion stands for the separation of powers. The judicial branch is not bound by what the executive branch determines its regulations to mean.

It was never "bound" to the interpretations; it was supposed to give some deference to them. Why? Because the federal agencies had the most expertise, often scientific, in the subject matter.

With so much junk science and so many "experts" lying about everything, it's a good thing that SCOTUS does not try to impose government fraud and coercion on the people.

The courts are not bound by science but by the constitution and the law.

Does no one remember Dr Fauci???
