NCAA Lawsuit: Judge denies injunction for Baylor football transfer seeking additional year of...

WACO, Texas (KWTX) - A McLennan County judge denied a request for an injunction Wednesday from a Baylor University football transfer who is suing the NCAA to challenge its ruling that he is ineligible to play another season.

Judge Ryan Luna of Waco's 414th State District Court, who has two degrees from Baylor, denied Yakiri Walker's motion for a temporary injunction, but set an expedited trial date in Walker's case for early October.

The result of Luna's ruling means that Walker, who was the projected starting center for Baylor this season and who played previously at Memphis, Colorado and Connecticut, remains ineligible and won't be able to participate in the Bears' fall camp starting next week.

If Walker prevails at trial, he possibly could salvage a portion of this season at Baylor. That also could improve his aspirations of playing in the NFL and possibly allow him to collect $200,000 in revenue sharing funds Baylor promised him contingent on him being granted an extra year of eligibility.

Walker, 23, a two-sport standout at DeSoto High School, declined comment after the three-hour hearing, as did his attorneys, Sabrina Tour and Daniel Hare. It is not known if Walker intends to appeal Luna's ruling.

Taylor Askew, who represents the NCAA, also declined comment after the hearing. Baylor spokeswoman Lori Fogleman said Wednesday the university also would have no comment.

Walker's lawsuit, filed earlier this month, alleges breach of contract by the NCAA for failing to administer and apply its published eligibility-waiver standards and claims the NCAA's denial of Walker's eligibility "reflects an arbitrary and inconsistent application of the Five-Year rule."

Typically, college athletes are given five years to complete four years of eligibility, unless the athlete can prove special circumstances exist to extend eligibility.

Askew argued that the NCAA's ruling in Walker's case was anything but arbitrary, saying it followed a consistent pattern of decisions in recent years in the rapidly changing landscape of collegiate athletics.

Walker contends he deserves another year of eligibility because he only played 96 seconds at the University of Colorado during the 2024-2025 season before he sat out the rest of the season after suffering "severe, debilitating mental health issues."

"Yet despite the medical issue and the extremely limited playing time less than two minutes overall the NCAA has counted the entire season against Mr. Walker's eligibility," according to the lawsuit. "This case is not about asking the Court to substitute its judgment for that of the NCAA. Rather, it is about requiring the NCAA to honor and apply the contractual standards it adopted, published, and promised to follow when determining student-athlete eligibility."

After leaving Colorado, Walker started for Memphis, which was in the process of appealing the NCAA's ruling on behalf of Walker when he entered the transfer portal and landed in Waco.

The lawsuit alleges Walker, through no fault of his own, was deprived of two separate shots to play first when he was "redshirted" at UConn in 2021-2022, and when he was diagnosed with "adjustment disorder with depressed mood stemming from personal loss and a betrayal of trust that made continued participation unsafe and untenable" while at Colorado.

Walker testified Wednesday that "everything seemed off" when he got to Colorado, adding "it was like I wasn't supposed to be there."

He was grieving over lost grandparents while he was there, he missed Texas and his family and he lost weight because he had no appetite, he said. He said he cried on the phone to his father every day and contemplated taking his own life.

He met with Buffaloes Head Coach Deion Sanders, whose reaction to his problems was "shocking," Walker testified.

"He acted like an a--hole towards me," Walker told the court. "He was like, 'We are men. Get through this.' But it was my mental health. Something was off."

Walker left the team and started seeing a therapist, he said.

During cross-examination, Askew asked if his problems weren't more related to Colorado promising him he was going to start at center but tapped another player instead. Askew asked about a medical report in which Walker told a therapist he felt "misled and betrayed" by the Colorado staff.

"I was going through something way bigger than that," Walker said, acknowledging he wanted to be the starter. "I didn't know how to handle that and my family members passing as a young man."

Tours asked Walker if Sanders had dubbed him the starting center, would everything have been OK.

"No. I would have said I wasn't in the right state of mind to compete," Walker said.

The lawsuit alleges that Walker's circumstances "fall squarely within the NCAA's own definition of qualifying hardships warranting an eligibility waiver, including incapacitating mental health conditions and circumstances outside the student-athlete's control."

Exactly. Baylor shouldn't be scared to face any Big 12 team on their schedule this year. There's not a Big 12 team that should make Baylor sh:t their pants with the thought of having to play them.
Colorado? Kansas? UCF? Iowa St? Houston? Arizona St? BYU? Tcu? Tech?
Which one? None of them are scary, blueblood, dominant teams. Not. A. One.
Not saying there won't be tough games. At BYU will be tough. As will at ASU. Tech, maybe, but Dave's already beat Joey's a$s twice in 3 tries (by huge numbers). Then Tcu, biggest rivalry, always tough. UH maybe if they live up to the hype they're getting.

Big 12 sucks. But so does Baylor. Getting to 7 is gonna require Dave win a game or 2 he's not supposed to. And Dave Aranda doesn't do that.
My uneducated guess is 4-8. Also I'll throw this out there ahead of kickoff. Auburn is rushing for 250 pkus on Baylor in Atlanta.

If we dont get Wheeler and Walker elligible then I'd say take the under. Maybe we have a bounce back year but our offensive weapons seemed better last year. If we go under I just hope we can move on and get a good coach that brings hope to the fanbase.

Or offensive line is going to get destroyed. I don't follow Auburn recruiting, but I doubt they're bringing in community college linemen with no other P4 or G5 offers as depth pieces like we are doing

Last year we had what I'm assuming was a better team than this year's and we were at home and still got beat by 14.

Maybe handicappers are considering Auburn having a brand new coach.... but in this new era of NIL it does not take a coach 2 to 3 years to build their team anymore.

Unless I'm wrong, I think one advantage of auburns that is being overlooked is that their quarterback played at USF under Golesh last year, and Golesh is a huge upgrade over freeze

In 2024, we got off to a slow start, but we were fortunate enough to play a series of teams in the back half of our schedule who were in rebuilding years. The back half of our schedule this year doesn't have nearly as many teams like that

A little bit more of temporary pain will be better for us in the long run. Dave will never replicate anything close to 2021 ever again

Not so sure. Last years defense was atrocious for the most part. This year it should be noticibly better because CDA is going hands off and new DC Klanderman is running the show. In theory this years team should be better if the offense stays the same & the defense improves a few (or more) notches.

Auburn will have one of the best QBs Baylor sees all year under center. He's gonna run all of Dave's **** defense. It'll be a lot like last year. But Byrum Briwn is actually a good QB.

I but Bryson will probably look pretty good going against us too. IDK if he is even Auburns best rb.

And Alex Golesh is good coach. It will get ugly since it is practically a home game for them.

Will be nice to see Davey on the sideline, hands clasped behind his back, with his headset flipped up. Oh, and don't forget about the golf clap at the most random times…
