Biden gets to replace unless the rules are we have to wait for the new president and let the people decide. I can't tell.

Ask Biden. After all, the rule is named after him.
That was made up.

Biden said one shouldn't be appointed during an election year before the election. He said it would be okay after the election.

Now, Republicans have invented a new rule that a Democratic president doesn't get to make an appointment if the Senate is Republican.

It goes with the new Republican disdain for democracy in general.

Only a Republican President can appoint anyone to SCOTUS.

That's the new rule!

Joe Biden was one of 43 Democratic senators to filibuster Miguel Estrada, whom Judiciary Democrats' staffers described in a memo as "especially dangerous, because he has a minimal paper trail, he is Latino, and the White House seems to be grooming him for a Supreme Court appointment."

"This time the president will nominate a right-wing extremist who happens to have a Hispanic surname rather than a black face," Yale law professor Bruce Ackerman warned in the American Prospect after the 2000 presidential election in an article arguing that all of George W. Bush's court nominees should be blocked by the then 50-50 Senate.

Oh brother. You really are a hyper-partisan, true believer.

It is always shocking to me the number of adults that are so willing to down party propaganda like gin at a sorority party. They exist on both ends of the political spectrum. My next door neighbor is an avid Trump supporter who is convinced Trump will take office before the end of Biden's term. So many people lack critical thinking skills.

can't believe this is Clinton's last appointment. RBG was the other appointment.

Current justices
Bush 41 - Thomas
Bush 43 - Roberts, Alito
Obama - Sotomayor, Kagan
Trump - Gorsuch, Kavanaugh, Barrett
Biden - TBD

Er, I think a majority of both houses has to confirm a replacement VP. Don't know that Hillary would be able to muster that.

Also, she may not be up for slow jams and back rubs from El Presidente.

There's at least one potential nominee that both fits the Biden parameters and was a clerk for Justice Breyer.

Dang, you managed to make a different version I heard sound absolutely rational: Harris to the Supreme Court, Mancin to VP. I thought that was nuts, but you win

Judge K jackson would be the obvious choice that meets Bidens criteria. I am sure her name is on the short list already. Plus that get Biden an appellate level appointment as well.

Actually, this decision is a big one for Biden and the Democrats. The Democrats need a distraction from the Economy, COVID and the border, and ideally they want a nominee who presents a reasonable, experienced image to the public but the GOP would still oppose. The Democrats would get that nominee confirmed while selling the GOP as a regressive hateful party.

That pretty much rules out Harris, Clinton, or any high-conflict candidate, while leaving the door open for a number of contenders in the black-version-of-Sotomayer theme.

My guess is Jackson to be the front-runner, given Biden's prior interest in her.

Did he have to say the rest? Do you assume any Tom or Hairy Dick can get nominated without also being qualified?

At this level, there are only "equally qualified" candidates, then it goes to the presidents preference.

Even though Guliani or Michael Avenatti are lawyers, they don't get nominated. The senate isn't (didn't used to be) a rubber stamp for the president.
