Guess it wasn't that crazy of a request. I am sure there are all sorts of reasons why we should just skip straight to sentencing.

Funny, for a crowd that is so concerned with everyone getting fair treatment, they sort of punt on that concept with Trump.

It's a bit of an odd order, and one where the judge appears to be bending over backwards to give an appearance of "fairness" to Trump. Of course nothing short of an order returning all documents to Trump, tossing the case entirely, and forcing prosecution of the DOJ and entire FBI will ever satisfy Trump and the MAGAites as fair, but whatever.

The sides have until Friday to agree on the scope of the Special Master's duties and present a list of potential individuals to fulfill the duties. They'll never agree as to claims of "executive privilege" as falling under his/her purview. I suppose the next order, the one following the 9/9 deadline, is the one that might matter.

This slows the potential fed case somewhat, but Merrick Garland wouldn't allow an indictment before the mid-terms anyway.

its a backwards move only because Garland didnt do it originally.

After enjoying dozens of conversations with people across the board, the DOJ is running this all out of DC and no AUSA is attached(really weird) alot of investigative errors or abnormalities as if the people doing it are not used to evidence gathering.

Be interesting to see what comes of this.. I feel like the DOJ messed up some but Trump will still have to answer for things as this process continues.

This week we see the arguements for scope of special master. We will see what DOJ says, i expect Trump to argue 4th amendment violations.

I think this part is going to be more about legal grounds then facts of the case.

Granting a special master is a smart move. They should appoint one suggested by Trump's legal team. It adds a layer of impartiality to the process (and gives him one less thing to complain about).

if he gets all the docs classified to be considered unclassified then he only has to overcome why he had them. As unclassified documents, he declared them personal as his right under PRA(hypothetical arguement, not that i agree with it)

His biggest possible failure appears to be possessing NDI.. if he clears that hurdle then its really down to PRA violations which between him and the archivist.

Seems to be an overly broad siezure.. it will be interesting to see what the special master is asked to do by each party

Trump already answered that. The FBI took them out of the cartons where he was storing them.
Coversheets are very scary. Sometimes I put the old coversheets on the TPS reports. Management gets mad.

not true.. it is the possession of the documents that could have NDI in them.

If all are declassified, NDI is irrelevant and the rest is an arguement between the NARA archivist and president Trump. There is no timeline and no real penalty for this part of the arguement.

The reason all of this is going on is because incumbent president aka joe Biden asked for records from the archivist. Those records are to be sealed for a period of time unless it is for an investigation. Biden is pushing the prosecution of a political opponent. Clearly outlined in archivist letters and also in the DOj filings.

well, the problem is those 11000 documents included private tax returns and medical records.. not part of the subpeona. Bit of an over reach on the seizure but we already knew that..

The only question is how to make it last until 2024.

There will be a series of postponements and delays . But the DOJ will not drop this case ...they don't dare.

Besides, postponements will provide Dem radicals plenty of time to gauge if they can actually get away with imprisoning their political opponents without inciting an armed uprising .

Most people won't care of course. They are too busy trying to make their truck payments and catch up on past child support.

But if just 2 or 3 governors discover some real courage .................

I am thinking the special master chosen will be a retired judge who has done cases involving CIFA review. This seems to make the most sense to me.

It is also Trump. They can do anything to him, he is beyond the law but not in the way his opponents think. He has none of the protections of the Constitution. They can bug his offices, raid his residence, manufacture information about him, slander him, and hold media prime time events going after him, all with no charges.

The only thing they will actually charge him with is obstructing justice on an overdue book of 2 to 4 year old papers from the White House. Maybe the Espionage Act of 1917, but I doubt they will actually go there in an actual indictment (good for TV though).

Really sad how we are watching the US Govt go after someone and fish for crimes and no one cares.

Important conceptual points to help interpret what is reported: SCI = "sensitive, compartmented information," referring to compartments within Top Secret, conceptutally interchangeable with TS. So when you see "SCI" mentioned, it would typically mean "one or more compartmentations within TS."

Generally speaking, a security clearance gets you full access to materials marked "Confidential" and "Secret." The volume of C and S is so great that no one person could read or carry it all. You get what concerns your area, but there is no formal effort to compartmentalize, to restrict dissemination beyond the normal routing indicators (who has action, who is "cc'd.") Not so with TS. There is no "higher level" of classification, merely compartmentations within TS and that compartmentation is formally managed. You have to demonstrate "need to know" to gain access to each compartment, limiting the breadth of your access across the TS level, and your badge/file indicates what you are eligible to see. Yes, "need to know" matters everywhere, but at Secret & Confidential levels it's a matter of professionalism, of not asking about or revealing things you know shouldn't be shared with those who aren't involved in the subject.

Generally speaking, TS is technical in nature.
Exceedingly sensitive humint is a different story. (bears markings not found on the docs from MAL raid.)

Confidential is stuff that, if declassified, would in most cases beg questions about why it was classified at all. Very mundane stuff, admin details, etc....

Important conceptual points to help interpret what is reported: SCI = "sensitive, compartmented information," referring to compartments within Top Secret, conceptutally interchangeable with TS. So when you see "SCI" mentioned, it would typically mean "one or more compartmentations within TS."

Generally speaking, a security clearance gets you full access to materials marked "Confidential" and "Secret." The volume of C and S is so great that no one person could read or carry it all. You get what concerns your area, but there is no formal effort to compartmentalize, to restrict dissemination beyond the normal routing indicators (who has action, who is "cc'd.") Not so with TS. There is no "higher level" of classification, merely compartmentations within TS and that compartmentation is formally managed. You have to demonstrate "need to know" to gain access to each compartment, limiting the breadth of your access across the TS level, and your badge/file indicates what you are eligible to see. Yes, "need to know" matters everywhere, but at Secret & Confidential levels it's a matter of professionalism, of not asking about or revealing things you know shouldn't be shared with those who aren't involved in the subject.

Generally speaking, TS is technical in nature.
Exceedingly sensitive humint is a different story. (bears markings not found on the docs from MAL raid.)

Confidential is stuff that, if declassified, would in most cases beg questions about why it was classified at all. Very mundane stuff, admin details, etc....
It is the possession of the documents, not their classification
