I've seen even some leftists lawyers commenting on TV that this is where the case will likely fail on appeal. Forget that. Assume for a second that he did intentionally ask Cohen to pay Stormy and then bill him to intentionally mask it for some reason.
In no way does this indicate election fraud, which is the felony charge. I could come up with a long list of legitimate non-election reasons to do it this way.
That's where it becomes a witch hunt to me. You combine this with the bank fraud challenge which was an absolute joke (coming from an ex-banker) and the agenda becomes obvious.

The Appeals Court does not try re-try cases, nor look into whether it should be charged as a felony or misdemeanor, correct? The Appeals Court looks for mistakes of process, procedure and judgement by the Court, not making a new verdict or charge.
