Of course they did. Zero chance of building a five vote consensus. Punting the cleanup is very much their style.
How many cases get filed within the next 72 hours?
How much time, money and manpower is wasted to delay handling the inevitable issue?
If POTUS has an out, why not simply rule that way?
If not, the money issue needs to be resolved.
Punting is politics not good faith jurisprudence.
