Precedent is against you. Judges didn't throw out the cases bought by the NYAG, who ran for office promising to find a way to prosecute Trump. So why would they want to prove how biased they are by not allowing Trump to prosecute open/shut cases?

One could argue that it's more than worth the time, that it's the whole ballgame. The kind of lawfare Dems engaged in was so urgent and expansive that it begged questions about whether or not social contract had actually broken down. And the way the Senior Civil Service move into partisan alignment with Democrats is deeply, deeply troubling. If allowed to stand, it ensures that every future GOP admin would either be captive of the bureaucracy or at war with it like Trump is.

If Republicans do not strike back with equal or greater force, Dems will be emboldened to quadruple down on the lawfare next time they are in power.
