Today a judge ruled that the original judge should not rule on the appeal. Not really a surprise as this often happens.

What is a surprise is the idiots online thinking this means the killer will go free, that an appeal has been granted, that a new trial is happening and so many other crazy things floating around.

35 witnesses (only 21 testified in the first trial), a video, a confession. This is a win for the defense, but there is still a major mountain to climb. This is like killing one ant in an ant hill.

The race grifters online are the absolute stupidest group online. We wonder why they behave like they do.

You'll have to scroll back through this thread and point to race baiting on my behalf. He's always been guilty since he did not respond to the force given him with an equal amount of force. We can disagree on who started the fight and whether he had a right to be under that tent, but you have to meet three standards for a self defense claim. No matter where you stand on one and two, the third one is undeniable.

And just in case you're referencing my posts where I say Frisco ISD shares some culpability in what happened (this culpability does not absolve Anthony of guilt), you must have missed this gem from Jeff Metcalf's interaction with the media from yesterday.

Jeff Metcalf says his next mission is to change Texas law so parents can hold public school districts civilly accountable when district negligence contributes to a student's death. He said he plans to seek legislation when the Texas Legislature returns in 2027.

\So could he possibly end up with a longer sentence?
El Oso
How long do you want to ignore this user?
If retried, yes. There are five options if he gets retried.
1. Acquittal
2. Convicted (could be a lesser charge since manslaughter was an option last time, could be a lighter sentence if still convicted of murder; manslaughter definitely carries less time if jury goes that way in round two)
3. Convicted (gets the exact same sentence he has now from a new jury)
4. Convicted (gets more time than he got from the first jury)
5. Hung jury (gets a third trial)

Theyre digging up a bunch of dirt on Metcalf. He spray painted racist things and pushed a girl down at school. I dont know how that changes the fact that he got stabbed but thats where this is going now.

It doesn't change the fact that he was brutally murdered in cold blood, but as the defense is heaving up Hail Marys I'm sure they believe the more they can make the whole thing about race (which of course it wasn't about) the better their odds of success based mostly on ginning up even greater reaction from the pro Karmello racists and the additional pressure that will be brought to bare as a result.

None of that is true. That's just the stupid chimps lying. We've reared an entire generation of monkeys that think they can just lie whenever Didn't Earn It stops working.

El Oso is, and has been for some years, one of the very best posters on this forum. He consistently brings a thoughtful perspective, and often something I'd never previously considered.

You, on the other hand, probably need your milk and cookies before bedtime. Whatever, I hope you find a new hobby.

Because you absolutely suck at this one.

The left-wing media's toleration an proliferation of the slander and libel of a dead child genuinely makes me ragey. We let these stupid chimps make all kinds of rhegarded accusations with zero "fact checks" or ramifications for lying. These monkeys all need to be ignored.

While I don't find a ton of value in making it "personal," it am annoyed by those that struggle to make intellectual arguments outside of common talking points.

For example, El Oso posted how great it was for special education kids to be in normal classes. He posited that it not only improved the education of the special education kids but also the normal kids.

Of course, as usual I presented a simple question: if the above is true why should special education students not be placed in Advanced Placement classes?

If his claims are correct:
- Why are we denying AP kids the chance to have classes with special education students - assuming it is so valuable as he claims
- If being in normal classes improve the outcomes for special education and normal kids, putting then in AP classes would only accelerate those advantages

Of course, he could not answer those questions because they're clever and it takes more than just posting talking points. So, yeah, sometimes "thoughtful perspectives" are just an idiot pontificating about things he's not actually smart enough to understand. The bad news is it just reinforces the stereotype that most education majors are just really not very smart ... which is sad for our kids.

You misrepresented my argument here and you ignored my answers on that board. Anyone is free to go read that thread. The short version is here.

- Why are we denying AP kids the chance to have classes with special education students - assuming it is so valuable as he claims

We aren't. I repeatedly used my own SPED child as an example. He's in advanced math. He even skipped an entire grade level in math. He had to pass a test to qualify. Any SPED kids who passes the test can do the same. Yes, my son gets accommodations to help him succeed. And it's extremely valuable to both him and his classmates. I posted numerous studies. You claimed the authors were hacks. You misrepresented their qualifications worse than you represented my answers.

- If being in normal classes improve the outcomes for special education and normal kids, putting then in AP classes would only accelerate those advantages.
This is a false analogy. Pre AP classes are great, but if you aren't ready for them, they hurt growth. Thus the tests to tell us who is eligible and who is not. You treat education as a one size fits all kind of thing. It's actually very nuanced, and since you don't work in it, you don't understand it. That's okay. I probably wouldn't understand the nuances of your career either. The good news is I don't act like I actually know anything about your field.

I also did not major in education at Baylor. I ended up in this field quite by accident, but I publish fairly often and get calls from colleges all over the country about how to do the things my studies say will work for student success. I have fun and I get to see America on someone else's dime.

I also get theres a large number of posters on this board who have no intention of learning anything. This board is about shock and awe and amusement for them. I've known this about you in particular for a long time now. So as on the other board, good night. My attempts to help you learn something, or see it fit in a bigger picture, have come to an end.

All the "noose" hoaxes should be their own category LOL.

The good news is the fact that the virtually zero racism these days they're really having to stretch to manufacture it. However, these hustlers should not be let off the hook for slandering and libeling Austin, the Mississippi boys, an others.

Did you see the 75-page document on Anthony. He hit as the report said at least 2 girls in the face, and then all the crazy threats and even pretty clear premeditation.

Metcalf was a garden variety racist and bully. At least he was when he was 12.

Anthony is a demented sociopath.

I can also clearly say who initiated the conflict. Per court testimony Anthony was bulling the kids under the tent by calling them *****es and ******* and other various insults. He was aggressive and dared someone to touch him. Metcalf again per courtroom testimony said he did not want to fight.

Anthony should have been removed from the tent. Metcalf unfortunately for him was charged with tent security. By his verbiage and his actions, it is pretty clear Anthony planned violence. He had texts confirming he was on the edge, texts from the morning of the murder.

Were any of the allegations against Austin verified and documented or just accusations from the defense team. The story I read cited vague "court documents," which could just be a motion filed by the defense with specious accusations; not like we have great journalists these days that can do complex reporting.

#NotALawyer but IIRC most juvenile and school records are sealed, so not really sure how the defense would have access them; but I guess it is possible. There have been so many specious claims made about the victims I do not have a ton of faith in the defense's claims.

The Anthony behavior list seemed more verified with text messages and specific witness (girlfriend) and I suspect these would be normally subpoenaed as part of a standard criminal investigation.

Apparently there is a sealed juvenile case from 2023 (so Metcalf would have been 16, not 12 as someone said earlier). Parts of it were unsealed and read into the record at the appeal.

The problem is you don't have the self-awareness to realize you're not very smart. While that always gets labeled as being an *******, sometimes it's helpful to call a spade a spade - or in this case a moron a moron.

You claim that SPED kids enhance the learning experience of non-SPED students.

So a simple question was proposed - why should AP students be deprived of this educational advantage?

The fact that you cannot answer simple postulate that even a freshman philosophy flunkie posits just shows you're have very little intellectual acumen outside of the posted Talking Points.

The correct answer should be not to hate me for so easily outsmariting your moronic positions but learning from those exponentially more intelligent.

I mean I could easily outline why you cannot / will not respond .. I was just trying to have ****s and giggles watching you squirm. The answer is obvious to anyone with a triple-digit IQ.
