Duke smartly negotiated exclusive NIL rights. If this goes the way I hope it does, He is about to experience generational debt due to material breach + consequential damages.

If I were Duke, I wouldn't stop there. I would go after anyone who so much as texted him about leaving for Miami and would go after them for tortuous interference. Maybe it sticks, maybe it doesn't, but enough is enough.

makes me wonder if we were truly unable to sue Rob Wright last year because the contract wasn't properly constructed, or if we simply turned the other cheek and elected not to sue him...

I doubt our lawyers don't how to construct an enforceable contract. I suspect we didn't want to be the first to initiate a suit like this for obvious PR reasons. It's kind of the opposite of the we pay players campaign/it's the we sue because we are too poor to match campaign.

What were the terms of Wright's contract. If it was up, there is nothing to sue over. Here the Duke QB was half way through a two year contract. Two to multi year contracts is the way to do this. What has created the madness is that everyone has been doing one year, year to year contracts for the most part thus far for some reason.

Currently there is a TRO that does not allow Mensah to enroll in another school, sign an NIL deal with another school or play for another school. The QB who had been next in line at Miami transferred and signed with East Carolina this morning. Miami's back up plan is the QB at Ohio. They currently do not have a QB.

I think this is the future, the players are going to learn it is a two-way street when they sign for the money. They are now pros, not amateurs. Contracts matter.

Frankly I am surprised that it has taken this long for someone to take off the kid gloves. Grown man money shouldn't come without strings attached. Ever.

It happened first with Washington. Their QB tried to break his contract to transfer to LSU. After they threatened legal action, he came crawling back with his tail between his legs.

With Duke going the same route, I think this will become the trend. And it should. If you want to transfer, fine. Make plans to do it before accepting and signing a contract with your current school.

I think we definitely will if we're ever put in that situation again. Likely, the only reason we didn't do it with Wright on the basketball side is because we didn't want to be first to do it. Now that that toothpaste is out of the tube, I think that will be standard operating procedure for all schools.

That said, I'm not sure how many multi-year deals we're handing out, so the Mensah situation may not be one we'll find ourselves in often.

Was Wright in the middle of a contract or had he just signed a new one with us or was he even still under contract? No one talking about Wright is answering those questions. They are just jumping to the co cushion Baylor was weak. My impression at the time was that Baylor and BYU were bidding for him. Baylor to renew and BYU for a first time contract. If that was the case there is nothing Baylor could have done to force him to sign a new contract with Baylor and sue BYU for out bidding them. If these were the facts with Mensah, or the UW QB neither Duke nor UW would have been able to do anything in their respective situations.

From my understanding, he had agreed to a new contract with Baylor. I don't know if anything was signed, though.

Either way, BYU obviously tampered to get him into the portal.
