Interesting that the drinking age is 21, but the serving age is 18.

Because it wasn't. And cooks in damn near every restaurant you go to are stoned.

Maybe it's true. Maybe it's not. But Baylor fans know as well as anyone that you can file suit for whatever the hell you want.

It's a very difficult case top litigate, much less win.

Roland will never have to pay out a mil on this one.

I've been buying General Liability Insurance policies for 40 years now.

As I've never been concerned about managing risk from the type of offense asserted in this particular case, I've never read the mountains of fine print and reams of endorsements attached to the back of those policies to see if they cover someone accused of this.

Anyone know? I'm just curious as to whether some insurance defense attorney handles this on the insurance company's dime or rather is the defendant going to have to pay his own attorneys to deal with it?

The same age you get to vote, join the military and head off to college. Does anyone think the 21 age limit has stopped anyone from drinking? Of course not. In fact, I would argue the 21 age limit encourages more binge drinking....which is horribly dangerous. Our friends at MADD used their bogus data to push this change all those years ago.

I would go with 19 only because when it was 18 the high schools had problems when most of the senior class was legally able to drink. Doesn't make too much difference though

GL will not cover you for this accusation. You would need a policy known as Employment Practices Liability for this. We advise to have these policies everyday in our agency.

Thanks so much for the input on that point. I've been without employees for the last several years, so my days of my agent servicing my workers compensation policies are behind me, and I'm strictly G/L for my business insurance.

But, even back when I was insuring against employee-related risks my agents never mentioned Employee Practices Liability to me.

I know this is a broad question -- is it expensive?

EPLI is not typically expensive unless you have some recent claim history.

If you have an agent only trying to sell you WC insurance, you probably need a new agent.

Expensive is a very relative term in the insurance world right now. EPLI is not a big ticket item unless you've got specific risk factors and/or claims in the past compared to other types of coverage. A solid Biz Owners Policy would get you both GL and EPLI along with some other items. Cyber is another one a lot of people don't understand that they are not covered for and that's a terrible thing.

Some things aren't meant to be posted on message boards due to their sensitivity. But I know for a fact that the owner is rarely if ever at the restaurant, and hasn't personally hired anyone in years, let alone "creating a system of hiring only young girls and grooming them for his and his friends pleasure" or whatever.

I'll leave it at that.

Yep, the precipitous drop in accidents, injuries and deaths all coincidentally happened in the year they raised the drinking age.

Ok genius, so you're telling me the drunk driving is only occurring for folks over 21?
BTW, if any of your "good data" is from MADD, it is complete BS.
