Having some knowledge of these agreements, the clause is probably a "morality" clause which is very broad. However, coaches sign their contracts with this clause. They are normally not so detailed as to "if you get a misdemeanor here is what happens" or "two DUIs versus one"...they are very broadly written as to include any type of illegal activity or immoral activity that might hurt the reputation of the university.
If it was found out that Beard was in a "throuple" (so weird to even write that), I don't think the morality clause comes into affect but that would be open for debate. If Beard were to hit his girlfriend (even if self defense)....maybe that is? That is what the morality clause is all about - bringing unwanted press to the school.
I am not in law enforcement nor am I an attorney, but my experience here is that there is more of a claim here than just "he said" and "she said". There are pictures and video and admissions by both parties of an incident. How can Chris Beard even walk on campus again or walk into a gym full of women athletes? This becomes problematic for the school and those it is supposed to care about. It also hurts their reputation nationally.
No amount of "I didn't meant to call the police" or "she hit me first and started it" is going to save Beard. He needs to get into therapy, accept the outcomes and move to another place. I hear that there may be some civil suits coming between "fianc (or is it an ex-fiance now) and Beard so this isn't over by a longshot for Beard.
