Assuming that this actually played out, I see an issue:

If Biden nominated Harris for SC and she was confirmed, the Senate would be exactly 50/50 with no VP to break a tie. Clinton could not be confirmed as VP if all the Republicans hold together.

Justice Sotomayor graduated Princeton Summa Cum Laude, JD at Yale, Editor Law Review,
nominated for Federal Bench by Bush 41, so 2 decades as a Federal Judge prior to SC. She may be more direct, blunt and liberal than many would like, but to suggest she isn't smart, or the tired old inference (you can guess why) epitomizes ignorance. You can get accepted to Princeton by who you know; No way you come out with all A's without earning it.

Plenty of educated morons out there, Sotomayor is an excellent example.

I would not think so. There would not be a vacancy at VP until she took the oath for the SC and/or formally resigns. There could not be a confirmation vote on a future VP. There would have to be a vacancy. Even here with Breyer's announcement that he will retire after this year's term, there will not be a confirmation vote until after he actually resigns.

The Speaker would not be involved in this process unless something were to happen to Biden while there is a vacancy at VP.
