She has been threatened to be removed for slow playing. Trump could not have gotten a more favorable Judge. There is a reason she is slow playing it.

That will push the trial to the point where it will not have an impact on the election, which before the arrival of Donald J. Trump was official DOJ policy under admins of both parties for quite a long, long time.....do not prosecute candidates during an election.

Smith, if we pause to remember, is the guy who steered the John Edwards prosecution to a mistrial, and got his prosecution of Bob McDonnell overturned by SCOTUS 9-0 (by a more liberal court than we have today). He is rashly aggressive, lives out over the tips of his skis. If any attorney needs to be made to prove his work, it is Jack Luman Smith. Stereotypical wild man. Andrew Weissman 2.0

Weissman, if we recall, got his prosecution of Arthur Andersen overturned by SCOTUS, because he persuaded the judge "to instruct the jury that they could convict the firm regardless of whether its employees knew they were violating the law." It's a relevant precedent for the Trump appeal on his case in NYC.

Cannon knows who Smith is. She's doing a fine job of making him act like a mere mortal.


As I said, Trump got the best possible draw of Judge in the best location. He needs to win to shut this crap to an end. But it needs to follow the process. She is catching heat over her actions, her competency is being questioned.

Democrats attack the way they do because they know middle ground fallacy is the default condition of the mind for most people, who will assume the existence of criticism implies malfeasance of some kind, somewhere. THat's why Biden chose the prosecution route rather than the civil route on this issue. But a dispute over constitutional law on the limits of presidential power is esoteric, only of interest to a small subset of the country. A prosecution on espionage charges, on the other hand, is saucy, steamy, soap opera drama that can capture imagination in wide swathes of minds, giving those who have hated him forever reason to hate him forevermore, and those on the fence reason to jump left instead of right.

All DOJ had to do is file suit in federal court to obtain an order for Trump to return them. Things would have worked themselves out as they normally do. But no. Not this bunch of progressive autocrats. They will obeyed or they will destroy.

By whom? She is an Article III judge and while there are some administrative things that Chief Judge Altonaga (GWB appointee) can do to her docket, short of impeachment, Judge Cannon is there for life.

If he did, you are correct. The question becomes how does he declassify? Just thinking it is declassified, no document management? I could even go as far IF he had a written policy that anytime he takes it to the residence it is declassified, at least there is some type of thought and control. But, after the fact in Mar Lago bathroom? Not so much.
The criminal act is possessing classified documents. That occured after Trump was president-there is no immunity issue there.

One of the defenses is that the documents were declassified while he was President. I agree with your take on the fact that he clearly did not declassify them while President, but that is an issue based on the classification statutes. Immunity should have nothing to do with the Florida case.
Too bad Trump isn't too old and feeble minded to be prosecuted so that "the possession is the crime" wouldn't apply...
Trump wouldn't have been prosecuted either if he just gave the documents back.

I know it is true. They tried for two years to get the documents back before they charged him. You just want to excuse Trump's contempt for the law with tin foil hat stuff.
