the first amendment protected that right up until your city council passed laws prohibiting it... that is a matter for the courts but we should not shoot the messenger when an officer is properly and without excessive force enforcing a law his community instituted

Respectful is not mandatory, but I would recommend it.
Brennan's point gets washed away when you start to use language like "non-threatening". "Judge, I considered his middle finger to be a threat."

If someone had gotten attacked by black people throughout their life and then treated all black people like criminals and thugs, instead of taking them on a case by case basis, you would rightly say that person was a racist for their "learned behavior" because of their "life experience".
