-QB Retzlaff was sued in civil court, but his accuser agreed to dismiss with prejudice as soon as Retzlaff claimed he had text messages disputing her story. Even still, Retzlaff conceded he had consensual pre-marital sex (against the honor code), and he was suspended 7 games. He didn't want to sacrifice half the season, so he transferred.
-Back in 2011 Brandon Davies was the starting center on the #3 ranked basketball team, and he confessed to consensual, pre-marital sex. He was suspended for the rest of the season, but he was welcomed back the following year.
-Jamal Williams was suspended for a year due to an honor code violation (2015), then came back to become the school's all-time leading rusher.
-Kyle Van Noy had his admission to BYU delayed a full year after a DUI, allowing him to get his life right before coming to BYU. He credits Coach Mendenhall for the tough love, rescinding his admission then bringing him back after he learned his lesson.
History shows that BYU does not sweep things like this under the rug. Rather, BYU will work with the student and leave it to his bishop (or other ecclesiastical leader for non-LDS students) to determine repentance and sincere commitment to the rules. If you mess up, there's accountability, but there's also grace and patience with human frailty. You may be suspended, but you'll be welcomed back after getting your priorities straight. And they'll try to keep it confidential to not embarrass the student, something that is near impossible with athletes.
BYU may have known that Kingston engaged in pre-marital sex (he claims it was consensual), and he may have experienced some sanctions as he worked through private repentance with his ecclesiastical leaders. It would not be at all surprising if that happened away from the media or anyone else before last season even began. I highly, highly doubt that a university that doesn't allow coffee on campus would allow a known rapist to play.
If Kingston is guilty, may he go to prison for a long time. If it was indeed consensual as he claims, then I hope that both the young woman and Kingston can move forward without this dragging them down. It's a rotten situation for all involved, regardless of what happens next in the court proceedings.
In thinking of far less important things, I doubt we'll ever see him in a BYU uniform again.
