Have a really hard time with this one. No doubt the Travis County DA is as bad as they come. He truly is as incompetent DA as any in the United States, and his decision not to prosecute criminals has made Austin unsafe.

But this man was tried by a jury of his peers, who believed he did something wrong. And believe it or not, Travis County juries aren't the bastion of liberals that people think they are. They are very diverse in both race and politics.

I haven't seen all the evidence, but I suspect there is a lot more to this story.
I think the guy's text messages and social media posts hurt him a lot. He was basically telling his friends he was going out to hunt libs.

So Facebook posts can now get you convicted.

We have a word for that "thought crime"…and the USSR specialized in that kind of prosecution.

A liberal jury and DA in Austin was unwilling to set aside their personal political views and judge the case. A mob surrounded a man's car and a thug ran up and pointed an AK at him.

Those were the only relevant facts that mattered…not Facebook posts or social media history.

I don't know, the dead blm rioter's own video before he went and attacked the Uber driver is pretty damning of the deceased itself.
Our vibrations were getting nasty. But why? I was puzzled, frustrated... Had we deteriorated to the level of dumb beasts?

Red, tell me more about this "liberal" jury. Do you have any knowledge of the jurists other than the fact they made a decision you dont agree with?

Do you have access to all the info the jury heard?

There are several lawyers here on the board. Is there any reason to believe the shooters lawyer would allow a liberal jury?

Do you have any evidence that all White juries in Philadelphia Mississippi in 1965 were motivated by racism?

Was on the jury of a rape case and one jurist told the rest of us

'There is no such thing as rape. It is physically impossible. '

So oh yeah juries are infallible .

Many countries actually don't have jury trials for criminal cases. You go before a panel of judges.

But the point is not if a jury trial is better than a magistrate trial (bench trial)

The point is that is a toxic political envoiroment...in a place like Austin that prides itself on one party rule and ideological conformity...this American Army Sargent was not going to get a fair trail at all.

Guess it all boils down to whether or not you believe citizens have the right to surround an innocent driver's vehicle and threaten him with a gun. If you believe mobs have that right, during a 7 month stretch of deadly leftist violence all across the country, then no matter what happened you're going to smirk at this case's outcome. If you think innocent drivers should have the right to meet a threat of death by an armed mob with an equal force, then you'll have a problem with this verdict. It's funny, many of the same people who claim Ashley Babbit deserved to be shot for being part of an unarmed mob are now claiming this armed man who threatens a delivery driver deserves justice for the consequences of his decision to threaten the driver. Where he aimed his gun is meaningless if you're cool with Ashley Babbit being shot.

I dont know enough about the facts to side with the Uber driver or the dead man. Unlike the jury, I didnt get to listen to the trial and hear and see testimony.

But 12 of this mans peers did. They found him guilty. Most here fall into the same political party and seem overjoyed our governor will throw away the jury decision and judge the case himself. I am sure the other side of the aisle will cry and moan. i think if the tables were turned the dems would celebrate and the repubs cry and moan.

Why are so many willing to ignore a jury finding and want to go with an elected leader. Letting this become a political issue will not end well, IMP.

Why not have faith in the system and Let the appeals court and the pardon board(not an elected official) review the case and make a decision.. is that ok by you or are we not allowed to let the Texas justice system work beyond step one?

One factor to keep in mind, was brought up today by Dick DeGuerrin. He mentioned that the appeals process in a murder case can take years, during which time the defendant - having been convicted - would remain in prison.

DeGuerrin also said he thinks it is inappropriate for the Executive Branch to interfere this early.

The Castle Doctrine extends to any vehicle routinely used for transportation, including planes, trucks, cars, golf carts, and ATVs. Vehicles are considered your property and covered by the law if you face an intruder/threat

Texas follows the castle doctrine. When the people are at home, work, or in their car, their right to use self-defense is at its greatest.

you are more optimistic than me, I expect more of these cases testing castle doctrine self defense especially in the larger urban areas of the state and doubly so if it is a white person shooting a minority.
