According to San Jose State University Volleyball player Brooke Slusser and others on the team - Blaire Fleming, a biological male playing on the girls team, asked a member of the Colorado State University team to intentionally injure Slusser during a match.
Fleming allegedly asked members of the CSU team to spike the ball in Slusser's face - because Slusser did not agree with having a biological male on the team.
Now Slussler is saying the university is downplaying the allegations, and engaging in bias investigation,
"It's a situation that I thought the worst of it was having to share a locker room and a team with a man, then to find out that he's basically trying to harm me on the court because I don't agree with him playing on a girls Volleyball team is disgusting"
"The player who does these types of things should be kicked off the team, not protected"
When the Athletic Director of the team was asked about the ongoing investigation, he replied "I'm done" and walked out of the interview.
Slussler claimed that investigators didn't have anyone look at the film that had any knowledge of volleyball, but instead took the words of Fleming and people that support Fleming- as truth.
Fleming joined SJSU in 2022 after playing boys' volleyball in high school.
Fleming was able to hit the ball at speeds up to 80 mphwhich is much faster than typical female playersand raised injury concerns during practices and games.
Slusser, a co-captain who transferred to SJSU in 2023, claimed she was not informed of Fleming's biological sex during recruitment and was forced to room with her on trips, violating her privacy and religious beliefs.
This led to team divisions, with some players supporting Fleming and others, like Slusser, joining lawsuits arguing it compromised fairness, safety, and scholarships.
In 2024, five Mountain West Conference teams (Southern Utah, Boise State, Wyoming, Utah State, and Nevada-Reno) forfeited matches against SJSU, over safety and fairness concerns related to Fleming.
JSU's coach, Todd Kress, was accused of favoritism, such as not enforcing team rules on Fleming because he is tr*nsgender, while harshly disciplining others.
Associate head coach Melissa Batie-Smoose was suspended and later fired in November 2024, allegedly in retaliation for supporting Slusser's complaints and filing a Title IX claim.
