So if you purchase a home which actually is your primary residence on a 30yr loan, then some number of years down the road you decide to move to a 2nd location and obtain another 30yr loan to purchase it but keep the original house......are you legally required to refinance the first home on a new mortgage (bearing a higher interest rate) just to avoid the allegation of fraud?
Of course not.
LOTS of electeds in Austin have done stuff like that. Former Sen. Sibley from Waco had a home in Waco and a townhouse in Austin. I have no idea what he declared or not on his mortgage, but he did declare the townhome as his "homestead." (a potential political problem - residency - for someone seeking to represent Waco.) I asked him about it directly in a one-on-one lunch. He was honest = he declared the Austin townhome as his homestead because it was worth a lot more money than his Waco residence. I nodded and we moved on to other topics.
Res ipsa loquitur: Paxton has not been prosecuted for anything he is alleged to have done. So the worst that can be said at this point is that he's incautious about appearances. Against that, he has a stellar record on the issues, which is why voters keep re-electing him. (I'm not sanguine about his chances in 2026, though....)

fed board member simultaneously purchased two primary residences in two different states vis Paxton stacked his mortgages up over time in the same state.
Not the same set of circumstances = not the same set of potential violations.
You'd have to look awfully hard to find an example of someone who decided to move to a new residence but keep the original home as rental property deciding to go back and refinancing the original property as a second residence just to avoid the appearance of impropriety. I would not be surprised were we to discover that a 3-digit number of Tx current lege members have done that or similar.
But, hey, NY state changed law to facilitate their AG going after someone she campaigned on destroying via prosecution over a 10-yr old misdemeanor allegation of falsifying business records for the ostensible purpose of getting a lower rate on a loan (which he qualified for and paid back in full), then tied it to an ostensibly larger (and uncharged) federal crime in order to elevate it to a felony, then levied a $500m dollar fine to punish a political opponent. So if that's the standard now, by all means, let loose the dogs of war and clean house.
