You cannot run a worldwide network of clandestine human sources if you keep hauling them into court for public testimony and cross-examination. So you have a stable of judges with clearances who can hear/read highly classified intel and issue warrants for LE to investigate and develop other evidence.
FISA as structured is not the problem. The problem is that the people involved in it are not being held accountable when they commit malfeasances. We need to impeachment and prosecutions, as appropriate, for those who abused the process for personal or partisan reasons.
Doesn't matter what kind of law we have if nobody is held accountable for violating it.
