Under typical State or Agency contracts they would have filed a bond and we would have a claim against them to fix it. We would never do final acceptance until the work was complete and the CEI signed off/They would be on the hook for this and involved in the settlement. The private sector transaction is the LEAST secure way to provide public infratructure. You do not build and maintain public parks this way.
