Is it necessarily on Kanter and White to prove they are women? I honestly don't know if that's true. New York State for example has laws protecting gender expression

Without anything specific in place, laws in more liberal states have pretty, well, liberal definitions of who can describe themselves as a woman.

A court case limiting Kanter's and White's self-identity could potentially set a precedent that supporters of the trans community might actually not be in favor of.

Business Reason
IMO this is a WNBA issue because it's their stated policy to only employ "women" as their well-paid, high-profile players without defining what that means in a time when a lot of people can't seem to state a definition on what that means either.

Different people for all different kinds of reasons will always be on the lookout for high-paying high-profile jobs and if the WNBA doesn't set clear eligibility guidelines and/or follow them, that could be considered discriminatory hiring practices and they can be sued. Would they lose the case? I don't know. But the possibility is absolutely there.

So basically, they are like any other company that has to consider what their stated hiring practices are, if they are legal, and then follow them or risk being sued or charged with discrimination.

Social Reason
I disagree with the implication that this topic just fell into the WNBA's lap. As an organization, they have publicly supported trans athletes in the past through social media and statements made by high profile people within the league

I'd start with how they present themselves. This is an obvious rouse. Make any argument you'd like, these are not trans women.

Again the left for years has said it is not about "presenting" or dressing in dresses or any other certain type of clothes but how a person feels.

They have pushed multiple trans "women" that did not wear makeup, clothes from the women's section or come across as female in any outer way…. They just identified as women.

And how does the State of New York, where the WNBA HQ is located, define "women"? If White and Kanter can qualify as women under New York State law, and the WNBA doesn't provide any definition or limitation beyond that, then legally could they be eligible? That sounds to me like something that could be argued in court.
