When you aren't fighting a uniformed army with clear battle lines, bases, or infrastructure. When your enemy actively and intentionally blurs the line of civilian and combatant to gain both a military and political advantage. But you and others choose to ignore the nature of the conflict and judge it through traditional war that was how the Geneva conventions were designed (article 44 for example). Or you can acknowledge the "nuance" and evaluate it beyond simplistic political sympathies from the perspective of some aggrieved people being oppressed and hopefully not driven by more nefarious ideals.
