The judge allowed the prosecutor to identify Penny as "the white man" throughout the trial.
It's a fair trail. Lol
That's incredible. Talk about reversible error.
Once had a trial against a lady whose husband killed himself. Was a prominent plastic surgeon, and had purchased a multi-million dollar piece of equipment on credit. Well, after he passes, wife sells it and pockets the money without paying off our client's lien.
We filed suit against her, and her lawyer told the Court that throughout trial, he wanted to refer to his client as "the widow." I argued that was prejudicial, but if he did so, we would get to explain how she became a widow. We would get to explain that her husband learned she had been having a years long affair with his business partner, went to confront them one night, and shot the guy in the chest (but he survived). Husband then goes to his parents house and kills himself in the car. Business partner recovers, marries the widow, and then she cheats on him so they divorce.
Needless to say, her lawyer decided against referring to her as the widow.
