In both the NFIB v. Sibelius and Bostock cases there were rumors leaked that a conservative justice was leaning toward a vote with the left. Last week it was reported that Roberts wanted to uphold the Mississippi law in Dobbs without overturning Roe and that he was trying to pull a conservative justice away from the majority. Perhaps in this case, similar to NFIB and Bostock, the leak is meant to pressure conservative justices to hold the line. That would be bad news for pro-lifers, as leaking the full opinion seems a desperate act and would suggest that one or more conservative justices is seriously wavering. Nothing in D.C. ever surprises me.
But if I had to guess, Politico did not get this draft directly from anybody at SCOTUS. Instead, a clerk shared it with someone outside and that person then leaked.
It could be that it was not intended for further release, although that doesn't lessen the breach of protocol. And given that the Federalist Society basically runs the Federal Courts it would not stun me if the draft opinion was circulated in those circumstances.
Not to say that a liberal clerk leak isn't a likely conclusion.
