Extremely unlikely. He would have to show malice on the part of the NFL because he is a public figure. That is a very difficult standard to establish. In any event, that would take years to conclude, and he would have long since served his suspension.

How about if he can show a pattern of inconsistency in the discipline administered to previous alleged offenders? Would that merit any consideration by the courts? Or could he, not that I would advocate this, pursue a civil rights complaint given how Josh Brown was treated compared to all the others found to have been in violation of the NFL domestic violence policy.
That goes back to the wide discretion the NFLPA gave to Goodell. Part of that discretion is deciding the appropriate length of suspensions under the facts of each individual case.. And courts are very hesitant to delve into the facts of each particular case to compare and contrast the similarities or dissimilarities between cases. Courts typically don't review the outcome to determine if it is correct. They just make sure the process that the parties agreed to was utilized.

The NFL has admitted that the girl lied about one incident. But they say they have evidence in the form of pictures with metadata proof of when they were taken that match up with her story about 3 other incidents. They also say they have corroborating witness statements. Not unlike Title IX with Baylor football players, now is not the time for an NFL player to be accused of domestic violence. The outcome is pretty much certain.

Cowboys TE Rico Gathers has been getting first-team reps with the red zone offense in 7-on-7 drills.
There are a lot of qualifiers there, but it's still notable. The converted basketball player has lit up the Cowboys' first two preseason games, posting a 7/106/2 line. He's been a mismatch. The Dynasty league stash is going to make the Cowboys' 53-man roster. He'll need to prove his worth as a blocker and special teamer to crack the 46-man roster on Sundays.

So he had an investigative team do the leg work on gathering evidence, conducting interviews etc. to present to him. I guess he thinks that appears to be more objective.

However, it's pretty incredible that the decision maker in a "he said she said" case that comes down to credibility wouldn't talk to the people whose credibility is the determining factor.

Rapoport: Elliott's appeal focused on credibility of alleged victim

Cowboys running back Ezekiel Elliott will file the appeal of his six-game suspension on Tuesday or Wednesday, sources close to him say, with the hope of getting back on the football field as soon as possible.

With that in mind, his legal team is preparing the arguments for his appeals hearing, either with Commissioner Roger Goodell or his designee. A portion of his argument, according to those familiar with it, revolves around the credibility of his alleged victim. Elliott will attempt to show that the NFL's suspension did not accurately weigh that factor.

According to documents obtained by NFL.com, Elliott actually filed an official incident report alleging harassment with Frisco (Texas) Police on Sept. 5, 2016 against Tiffany Thompson, identified by the league as his alleged victim.

The report details that police were dispatched to Elliott's house because he received "50-plus" phone calls from his ex-girlfriend between 2:39 a.m. and 10 a.m. She called from a blocked number and Elliott answered several times, he told police, informing Thompson she was not supposed to be calling him, per the report.

Elliott provided a written statement of the incident for police.

Elliott reported the claim one day before Columbus Police announced it would not press charges against Elliott, though the incident happened two days before that.

Columbus prosecutor Robert S. Tobias declined comment when asked in an email if his office was aware of the harassment claim before making its charging decision, NFL Network's Tom Pelissero reports.

Frisco Police Sgt. Jeff Inmon told Pelissero the harassment case is currently inactive. In addition, Elliott told police that Thompson hacked into his email account, found phone numbers and called them to leave "untruthful things that can hurt his image." Thompson told league investigators that she contacted women Elliott was "messing around" with.

Goodell used this information earlier while forming his decision, but Elliott's team hopes to highlight it in the appeal.

In his letter to Elliott, NFL Senior VP B. Todd Jones, special counsel for conduct, specifically addressed the credibility of Thompson. He wrote that these issues received "careful consideration" by the commissioner but added "no finding, and no disciplinary action, was based on simply one individual's statements. Instead, Jones wrote, the findings are a combination of "photographic, medical, testimonial, and other evidence that is sufficiently credible in the Commissioner's judgment to establish the facts, even allowing for concerns you and your representatives have advance about the complaining witness's credibility."

ESPN's Adam Schefter forecasts Ezekiel Elliott's appeal hearing to take place Aug. 29. It's good to have clarity on the date, but this being the NFL, we'll likely get an appeal to the appeal. With the situation so uncertain, fantasy owners should abide by the facts on the ground. The facts on the ground are that Elliott is suspended for the first six games of the 2017 season.

ESPN's Todd Archer thinks the Cowboys "could" use a "committee approach" at running back during Ezekiel Elliott's six-game suspension. Preseason usage suggests Darren McFadden will be the guy while Elliott is suspended, but Alfred Morris has looked like the better player through two games. That said, the Cowboys were shopping Morris during the offseason and had him working behind Rod Smith early in camp.

Apparently Zeke and Jerry's getting so ticked off with Goodell was that Goodell pretty much said that Zeke was a Domestic Abuser. Normally he says that a player violated the NFLPA code.

This could end up being a very expensive problem for the NFL as Zeke was declared not guilty by the law. And it took away all sorts of Zeke's endorsements

This kid may end up being a 'training camp star' only but he has some potential:

Lewis Neal The undrafted rookie has had a startlingly good training camp, and it certainly looked like the coaching staff wanted to see if he could handle a challenge. In the Compete Period yesterday, the coaches put Neal who stands at 6-0, 258 up against his 6-4, 322 LSU teammate, La'el Collins. Strictly speaking, Collins won the matchup, but it was no easy victory. Neal has an impressive amount of power, and he handles himself well against much larger players. It was just another piece of what has been an impressive performance for Neal this month.

The NFL has tabbed Harold Henderson to hear the appeal of Ezekiel Elliott's six-game suspension.
Henderson regularly oversees appeals hearings for the league, and the NFL tried to push him as an objective, non-biased party by having NFL Network reporters tweet that Henderson reduced Greg Hardy's suspension from ten games to four. However, PFT's Mike Florio -- an attorney by trade -- notes that Henderson's presence in the case "significantly" drops the chances of Zeke having the suspension overturned. "At best, he'll get a mild reduction," Florio wrote. Florio also states Henderson's hiring "significantly" increases the chances Elliott eventually files a lawsuit. Elliott's appeal will be heard on August 29.

One of the most impressive players through two weeks of preseason, Gathers was hurt in Tuesday's practice. Consider him week-to-week for now and doubtful for Dallas' third exhibition. Gathers has a 7-106-2 line this preseason.
