I cannot get past the First Amendment. The DOJ cannot get that far.

I suggest you read all of the Constitution.
Did. The charges remain malicious and unconstitutional/

Sucks for you, but meh ...

So if a person walks into a bank and asks for all the money then they should not be charged with bank robbery because it is their first amendment right to say such a thing? That is just plain silly.

Trump asked Mike Pense to overturn the election results. He is guilty of attempting to defraud the citizens of the USA. That's the kind of things dictators do to stay in power.

um.. no. My bank robbing dude would not be charged with defrauding the bank. He would be charged with attempted bank robbery.

Trump is guilty of alot of things, not defrauding the citizens of the United States on Jan 6..

What do you mean? Do you imply that there will be rioting in the streets? Do you imply that henceforth all Presidents will be put in jail?

Trump crossed a line on Jan 6 by conspiring to overturn the election. If he is found guilty he should do the time.

Do you understand the ramifications of what he tried to do when he lost? He wanted the VP to cherry pick electors to give him a victory, while inciting a mob outside of Congress. That is ok??

It is sufficient for the government to prove that the defendant knew the statements were false or fraudulent when made. The government is not required to prove the statements ultimately resulted in any actual loss to the government of any property or funds, only that the defendant's activities impeded or interfered with legitimate governmental functions.

The same individuals who attempted to impeach Trump twice only because their opposition party controlled the House of Representatives

The same individuals who falsely accused Trump of Russian collusion based on a phony dossier paid for by their own party operatives

The same individuals who raided Trump's home for documents when their own VP had done the exact same thing

Such individuals don't give a tinkers damn about right or wrong or future ramifications of their actions .

Only because Pence said no. Accepting alternate electors is impeding or interfering. If Pence testifies what he has said, Trump will be found guilty. Rightly so, as White House counsel is on the record telling Trump this is not legal, as did Pences counsel.

let me know when they charge Mike Pence with conspiracy to defraud..

He clearly made statements in public that followed the same line of thinking and then did his job on Jam 6th.

Again, nothing Trump said or did rises to the level of impeding or interfering with a govt function.

Trump has been incredibly stupid in how he went about his business, he brought this stuff on himself. Between his mouth and impulsive behavior he self-destructed. Just like Atlantic City, USFL. his businesses... Too bad, he had some good policies, he needs to get Halley, Pompeo or even Scott to pick up the banner and he needs to bless them. Get a professional in there to execute his policy ideas. He is a trainwreck in public office. Besides, he prefers rallies to governing.

The only thing he was really good was being a persona on TV. He should go back to that...

nonsense..

He is most likely guilty of having papers he wasnt supposed to after presidency was over(not sure it rises to espionage act but whatever) and several other things but the law is clear and the bar is set, he didnt get there.

Will he be found guilty? Yes.. in probably every case against him. Trying Trump in DC that voted 96% for Joe Biden isnt a fair venue. Its probably the most biased venue against him in the entire US. This isnt some bias or deep state conspiracy, its real life in 2023. You can go to jail for your political affiliation.

Wake up, it isnt red vs blue, its us(the people) vs them. The elected officials stopped running Washington years ago. The unelected admin state is running the country.

Agree with you here, Doc. I know you're not sold on DeSantis, but right now I think only he and Donald Trump would have the testicular fortitude to tear down and eliminate the corruption in D.C.

My biggest concern would be that if one of these two does win the Presidency in 2024, the CIA (and friends) are gonna go November 22, 1963 on them. We shall see.

Whatever GOP candidate ends up on the ballot, that's who I'm voting for. New supreme court members are at stake with this election and we can't afford to let any democrat appoint another low IQ leftist.

If it's Desantis, I will vote for him. I'm very skeptical about Ron because he's got many members of the establishment endorsing him and his campaign is built by the Jeb Bush team (RINOs). Is his populism just a ruse?

I don't think you're educated on how DC truly works and how bad things actually are.

The posts you make on this site lead me to believe that you support post modern and leftist radicalism. Your hatred for Trump leads me to believe that you think his supporters are subhuman.

Do you guys understand what the ramifications of throwing Trump in prison are?
A chance at preserving our democracy, if we can elect a republican who has character and integrity.
We need to elect a Republican who can destroy the corruption within the system. The level of corruption is astronomical.

If your idea of a good president is likeability then you have the entire premise wrong.

Also, you're a woke leftist larping as a centrist. If Trump supporters were murdered by the millions it would make you happy.

Am comfortable that DeSantis is no 'rhino'.

However the media is already attempting to bury his campaign and Dem's will quietly support his weakest rivals. ( as they successfully did in republican senate primaries ).

And of course if all else fails and DeSantis pulls in 87 million votes in the 2024 general election; Gavin will magically draw 101 million votes.

If DeSantis complains he will share a prison cell with Trump.

Welcome to our new democracy.

For those that still support Donald Trump, I quote Mike Penske, "Read the Constitution."

He did not defraud the citizens of the USA. He attempted to get Mike Pense to do so.
nope

He most certainly did. Why did Mike Pense all of a sudden become persona non grata in the Trump administration on Jan 6. It was because he refused to throw out certified election results.
he did not attempt to get Mike Pence to defraud the citizens of the United States.

Good Lord..

It is sufficient for the government to prove that the defendant knew the statements were false or fraudulent when made. The government is not required to prove the statements ultimately resulted in any actual loss to the government of any property or funds, only that the defendant's activities impeded or interfered with legitimate governmental functions.

The defendant's activities did not impede or interfere with legitimate government functions.

Ramaswamy 2024

Well, I guess we will see in a court of law. Oh, I forgot if he is guilty it is a deep state conspiracy. If he is vindicated in WV the truth won out, right? There is only one possible right answer, yours....

The unelected "admin" state only does what the elected officials say, if you are talking about the Federal worker bureaucracy. Decisions are made in the appointed Secretary's office and carried out through the Departments,

It has been my experience in DC the more the elected officials get involved in day to day decisions the worse it is! You do not want elected officials making day to day decisions or awarding grants or funding, it creates a nightmare.

Jack Smith lied in the banana republic indictment by maliciously omitting "peacefully and patriotically" demonstrate. He therefore could be indicted under the same "legal" theory.

It's another Stalin show trial to get all focus on January 6 mythology and not on Bidenomics or Ukraine.
