Hiring Danchenko as a paid source protects him from public inquiry. Protection of sources & methods. Yeah, prosecutors and congressional investigators can get to him, but have to jump lots of hurdles that take lots of time and end up with lots & lots of redactions of anything revealed to the public.

For some reason, people cant wrap their head around the fact that POTUS has powers that nobody else has.. the executive branch/admin state can not limit Potus' power. (No Trump can not think declassification but he can declassify verbally and in writing almost anything imediately)

The Eleventh Circuit panel observed that on the most critical question before the court - namely, whether the government had exhibited a "callous disregard" for Trump's constitutional rights - even Trump did not claim such a thing, and Judge Cannon concluded there was no such evidence. That alone would have been sufficient grounds to deny Trump's special-master petition, let alone to carve the classified documents out of it.

Nevertheless, the panel proceeded to assess other relevant factors.

In concluding that Trump failed to show that he had any need for the return of the documents at issue, the panel emphasized that Trump had failed to proffer any evidence that he had declassified the documents. On that score, the court noted Trump's resistance to Judge Dearie's admonition that it was his burden to produce evidence of declassification (which I've detailed here). Regardless, the panel observed that it "could not discern" why Trump, who is no longer president, would have a need even to know about, let alone keep in his possession, classified information that is encumbered by need-to-know restrictions - restrictions "that pertain equally to former presidents" - absent a dispensation from the incumbent president (which President Biden has not issued). Consequently, the panel rejected Judge Cannon's speculation that Trump might have a cognizable interest in the classified documents.

Valuations can be difficult to prove, but giving different valuations to different entities (insurance providers, lenders, tax officials, etc.) so you can derive hundreds of millions of dollars in benefit is pretty clear fraud.

You are letting your desire to catch Trump doing something illegal that is proveable. This is not that type of case, fraud is tough to prove. Valuation is an art, as much as a technical exercise. If he stayed with the professional valuations, he is fine. The other side is if the banks even used his valuations or did their own. If I were the AG, I would look into the preservation easements for tax impacts.

Unless they have him on tape telling them to commit fraud for his personal profit, you will have a tough time proving it. You are going to have two sets of expert witnesses talking methodology and assumptions, all subjective and different industry standards. You will have Duetsche Bank saying that the valuations not used and were consistent with the risk based on market conditions as they valued them. Tough road to hoe.

I agree. Just not big on the making him guilty in the media before they charge him, due process, and find him guilty. They are and have been in discovery for years...

NY has not charged him with anything. Yet, his businesses information is all over the media. I also find it interesting that all of 20 and 21, nothing. 2022 before midterms and now it is paramount that he is tried publicly by Congress, by DOJ and State of NY all these cases are now top priority. Midterms baby... I will believe they have something when they actually prosecute him.

There are still no charges. Duetche Bank has not said that they used the valuations or that they were wronged and there are no mention of taxes (if you over value, it would not help taxes!). So, I am not sure charges will ever come unless they just want to prosecute.

Regulatory requirements would force the bank to appraise any property purchased or leveraged. So this has to be about valuations on attached corporate or personal balance sheets.

If he had enough assets to secure the loan, 10-20% over-valuation on a few properties would not and should not have been an issue. So this is really a case on immaterial technicalities of a few items in the margins of a large portfolio balance sheet with substantial equity.
