The DOJ judge wrote that "the evidence shows that [Abrego Garcia] is a verified member of MS-13." In this context, "verified" meant nothing more than that an unidentified informant, for whom the government vouched but whom the alien did not get to cross-examine, told the government he was an MS-13 member.

Because the government offered nothing more than this hearsay claim, the DOJ immigration judge, in straining for corroboration, was reduced to theorizing that Abrego-Garcia's "clothing" could be "an indication of gang affiliation" although the DOJ judge conceded he was "reluctant to give evidentiary weight" to such a dubious consideration.
Yeah, his tattoos, clothing , associations, and behavior all being related to MS-13 was just one big ol coincidence. Poor fella.

Then the hearing will be a slam dunk for the government

Yes it was.

Only he got no hearing, so no dunk for the government.
Look, the guy needs to be out of this country. Just do it in a lawful manner

Garcia is back in the country where he is a citizen. He is their problem. Furthermore if he had come into our country legally rather than illegally we would not be having these arguments. Lastly, he had hearings in 2019. He does not get three or four mulligans because he does not get the decision he likes.

For those who say President Trump is denying due process to illegals. I disagree of course. See Below

According to the Migration Policy Institute and ACLU, approximately 75% of deportations under the Obama administration (20092017) were nonjudicial removals, meaning they bypassed immigration court hearings and judicial oversight.

In FY 2012 alone, 313,000 nonjudicial removals occurred, compared to 1,400 in 1995.

These removals often involved "expedited removal" or "administrative removal," where Department of Homeland Security (DHS) agents, such as Border Patrol or ICE officers, made decisions without involving an immigration judge.

I urge everyone to go online and read Justice Alito's dissent in the Supreme Court's 7-2 decision on emergency relief. The Court ordered "the Government" not to remove a "putative class of detainees" until the Court issues a superseding order.

In my opinion Justice Alito destroys everything the other seven Justices did in their Majority Opinion. I quote his summary. "In sum, literally in the middle of the night, the Court issued unprecedented and legally questionable relief, without giving the lower courts a chance to rule, without hearing from the opposing party, within eight hours of receiving the application, with dubious factual support for its order, and without providing any explanation for its order".

Sure seems like the Supreme Court went through a few contortions which broke some long standing procedures to prevent President Trump from removing numerous illegal gang members and criminals from our country in the fastest manner possible through this Alien Enemies Act. Did this decision give Supreme Court backing to activist judges like Judge Boasberg and others as they as mere district court judges take effective power from the Executive Branch and President Trump, rendering him incapable of fulfilling his mandate from the electorate on election day? Sure looks like the Supreme Court is giving itself and the Judicial Branch power the Founding Fathers never intended in our Constitution.

Garcia got due process that he did not deserve. He had an immigration hearing in which the judge ordered him to be deported. And under an appeal in the immigration system, a second judge agreed with the lower immigration court decision. The left, the democrats in congress, and the media are making the issue murky by saying all of these illegals, gang members and criminals deserve due process before we send them packing. No. They are ALL up for deportation because they broke into the country illegally. Period. Otherwise we are rewarding illegal activity. And there is no way we do that in our system of government if we want to maintain law and order. In other words since their first act was to break our immigration laws and come in illegally rather than legally, they forfeited their rights afforded to the rest of us. The proof is on them to say how they came in legally or they can be deported just for entering the country illegally. End of story.

I'll stick by it:

Quote:

Miller also worked with classmate Richard Spencer, as members of Duke's Conservative Union. The pair organized a speaking event which brought white nationalist Peter Brimelow to campus in 2007. Brimelow is the founder of the white nationalist group VDARE, which regularly publishes the work of eugenicists, nativists and other extremists. Spencer is arguably the most notorious white nationalist figure in the U.S. He is credited with popularizing the term "alt-right," and was scheduled to serve as the headline speaker at the deadly Unite the Right rally in Charlottesville, Virginia, in 2017.

In a 2016 interview with Mother Jones, Spencer confirmed his relationship with Miller, saying, "I knew him very well when I was at Duke. But I am kind of glad no one's talked about this because I don't want to harm Trump." From March 4, 2015, to June 27, 2016, Miller, at the time a staffer in Sessions' office, and subsequently as an advisor to then-presidential candidate Trump, sent over 900 emails to Breitbart News editors. Katie McHugh, a former editor at Breitbart News from April 2014 to June 2017, who has since renounced the far-right, leaked the emails to SPLC's Hatewatch in June 2019.

In 2009, Miller transitioned to a communications role with then-Sen. Jeff Sessions. While serving in the U.S. Senate, Sessions, of Alabama, was one of the anti-immigrant movement's strongest allies and regularly cited reports produced by anti-immigrant hate groups such as the Federation for American Immigration Reform (FAIR) and the Center for Immigration Studies(CIS).

Both organizations were founded by the late John Tanton, a eugenicist, white nationalist and the architect of the modern anti-immigrant movement. Tanton's views on immigration were best summarized in a Dec. 10, 1993, letter where he concluded, "I've come to the point of view that for European-American society and culture to persist requires a European-American majority, and a clear one at that."

During his time with Sessions, Miller became known for sending mass emails on immigration to fellow Republican staffers. According to one Republican staffer who spoke with The New Yorker, Miller's immigration-related emails regularly shared links from "fringe websites," so much so that the staffer admitted, "I just started deleting them when I'd see his name." "Everyone did," the staffer added.

In the spring of 2013, Miller and Sessions played a key role in ensuring the failure of a comprehensive immigration bill introduced by a bipartisan group of senators who became known as the Gang of Eight. The bill sought to provide a pathway to citizenship for undocumented immigrants while increasing border security.

To orchestrate the downfall of the bill, Miller used Breitbart News as a space where he could propagate his anti-immigrant ideals. The ideas and stories Miller suggested to Breitbart centered on one goal: decimating the Gang of Eight bill.

While the bill ultimately failed for a variety of reasons, Steve Bannon, then the head of Breitbart News, lauded Miller and Sessions' role in stopping the bill, likening it to "the civil-rights movement in the nineteen-sixties." Sessions went on to serve as attorney general of the United States from 2017 to 2018.

From March 4, 2015, to June 27, 2016, Miller, at the time a staffer in Sessions' office, and subsequently as an advisor to then-presidential candidate Trump, sent over 900 emails to Breitbart News editors. Katie McHugh, a former editor at Breitbart News from April 2014 to June 2017, who has since renounced the far-right, leaked the emails to SPLC's Hatewatch in June 2019.

The emails show evidence of Miller's indulgence and sharing of the racist source material he relied upon to define the ethos of his immigration policies. Throughout the emails, Miller promotes literature, conspiracy theories, and policies supported by white nationalist and anti-immigrant hate groups.

Several of the emails show Miller's admiration for former U.S. President Calvin Coolidge, particularly Coolidge's implementation of the Immigration Act of 1924. Coolidge, a supporter of eugenics who once wrote, "biological laws tell us that certain divergent people will not mix or blend," instituted the bill to severely limit immigration from certain parts of the world. According to James Q. Whitman, the Ford Foundation professor of comparative and foreign law at Yale Law School, Hitler pointed to Coolidge's Immigration Act of 1924 in "Mein Kampf" as a potential model to be replicated.

During an Aug. 4, 2015 email exchange about halting all immigration to the United States for several years, Miller highlights Coolidge as an example to follow. In the email, Miller responded to the policy suggestion, which was made on a right-wing talk radio show, by holding up the historical precedent set by Coolidge, writing, "like Coolidge did. Kellyanne Conway poll says that is exactly what most Americans want after 40 years of non-stop record arrivals."

The emails also revealed how Miller engaged in peddling anti-immigrant conspiracy theories and nativist content. One of McHugh's stories for Breitbart, "Ted Kennedy's Legacy: 50 Years of Ruinous Immigration Law," used the 50th anniversary of the Hart-Celler Act of 1965 to portray the legislation as harmful to the U.S. because it did away with racial quota laws. Unsurprisingly, Miller was the story's brainchild. On March 30, 2015, he suggested the story idea to McHugh, emailing: "They opened the Ted Kennedy Center today in Boston. Another opportunity to revisit the '65 immigration law."

After the publication of McHugh's story, Miller praised it and explained why Breitbart was the only news media outlet covering the topic. According to Miller: "Elites can't allow the people to see that their condition is not the product of events beyond their control, but the product of policy they foisted onto them." The "great replacement" conspiracy theory Miller espoused in his email is also embraced by white nationalist who believe that whites are being purposefully replaced in the U.S.

Along these lines, Miller steered McHugh in the direction of content from other white nationalist websites such as American Renaissance. Founded in 1990 by Jared Taylor, American Renaissance is a self-proclaimed think tank which propagates pseudoscientific claims about the supposed inherent inferiority of nonwhite people. Taylor, in 2005, claimed, "blacks and whites are different. When blacks are left entirely to their own devices, Western civilization -- any kind of civilization -- disappears."

The Southern Poverty law firm is itself a radical hard left organization and basically a scam for enriching its already rich partners

They have even labeled pro-family traditional marriage groups as "hate groups"

1. It needs to be said constantly....the SPLC is a completely dishonest organization

And if you are worried about racism it apparently is a racist organization as well.

[Some employees at the Southern Poverty Law Center say the legendary civil rights nonprofit group suffers from a "systemic culture of racism and sexism within its workplace."

But one of the employees who spoke to CNN alleged the organization suffers from a "pervasive racist culture" and an environment in which a woman is not seen or heard. She also said qualified African-American employees were regularly passed over for promotions including one African-American colleague she describes as brilliant. She added, "My boss only hires white people."]

https://www.cnn.com/2019/03/29/us/splc-leadership-crisis/index.html

2. You have not shown us anything more than Miller opposes mass migration of 3rd world peoples into the USA (something the majority of Americans support)

The rest is classic guilt by association type stuff

"Look! Someone with non-approved views...and this person knew Miller!"

Miller is a straight up racist and a sociopath. If he weren't getting paid to lie, he would lie just for the fun of it.
Where is Miller's due process?
Where is he charged with a crime?

The first reply to my post is almost exactly what I expected, so thanks for getting it out of the way quickly.

I share many of your concerns about the SPLC and have criticized it in the past. Some of what's in their article, which I didn't quote, may be over-hyped or over-interpreted. But there's more than enough substance, and I've seen no one dispute these facts about Miller.

2. You have not shown us anything more than Miller opposes mass migration of 3rd world peoples into the USA (something the majority of Americans support)

The rest is classic guilt by association type stuff

"Look! Someone with non-approved views...and this person knew Miller!"

And the Left of course never applies that biased standard to itself
It needs to be said that Miller is completely dishonest person. And if you're worried about racism, he apparently is a racist person as well.

The article has Miller himself (not just people he's associated with) supporting racial quotas in immigration. He doesn't just want to "enforce the law." He wants to enforce laws that will Make America White Again.
