It's alleged that some of them are members, but we haven't seen evidence. So how do we know?

How Else Can Due Process Claims Be Resolved, Other Than by a Judge?

Invaders being repelled are not entitled to due process. It is absurd to think foreigners invaders have a right to a day in court. It's laughable.

The separation of powers means the US has three separate and co-equal branches of government that work together. None of them has an absolute authority over the others. Judicial review is not mentioned or implied in the constitution (although it is implied in Federalist #78). It didn't even exist until Marbury v Madison which resulted from events after the 1800 election. There is no judicial supremacy and there is no legal or constitutional basis to believe a district judge has the authority to dictate to the president how he can fulfill his constitutional responsibilities as commander in chief.

What these judges are doing more closely fits the constitutional definition of treason.

Does the president, under the Alien Enemy Act of 1798, have the authority to unilaterally order the removal of a class of aliens from the United States, without judicial review, when the nation is not at war and the courts are open and functioning,
it is not required to be at war.. there is an OR which separates requirements

Trump will probably win in court, why rush it and defy courts

Because every single day the criminals remain in the US they cost us taxpayers money. More importantly, they are threat to American citizens and our safety every day they remain. They are rapists, murderers, & terrorists.

Also, these rogue judges are dangerous themselves and need to be stopped as soon as possible.

Need to be filed on CJ Roberts as well. He has no business speaking out against Trump.

As much as I think his statements are foolish, that is not an impeachable offense.

Zero chance the judge gets impeached.

Waste of time.

However the vast majority of Americans appreciate Trumps attitude here. They want these criminals out of the country regardless of the games leftists are playing in the courts.

BTW there are many examples throughout US history of presidents acting decisively while ignoring federal court decisions.

You are probably correct but it's a political maneuver. They don't need to impeach any of these judges if they can convince them they might.

Most important, Trump is winning in the court of public opinion.

St. Peter gathered a group of angels together and gave them a special task. They were to find the best psychiatrist on Earth and ask him or her to go to heaven. After a diligent search, they located an amazing doctor in Switzerland. The psychiatrist said he wasn't really ready to leave Earth, but would do so if St. Peter thought he could be of help. "Well," St. Peter said, "we have this terrible problem. God has developed a horrible superiority complex. He's started thinking He's a Federal Judge."

I don't think it was cancelled, but for all practical purposes it was a moot proceeding. The court is without effective jurisdiction, and the detainees (even those who are not gang members) are without remedy.

The Fifth Circuit Court of Appeals has affirmed the preliminary injunction against President Barack Obama's executive action that would potentially have shielded approximately 4.4 million undocumented immigrants from deportation and allowed them to immediately apply for work authorization. President Obama announced his immigration plan, which included an expansion of the Deferred Action for Childhood Arrivals (DACA) program and created a similar program, Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA), nearly a year ago, but quickly encountered hurdles when his executive action was halted by the U.S. District Court for the Southern District of Texas in response to a lawsuit brought by 26 states.
